(‘’Auglinn’’, “us”, “we”, or “our”) has issued this Data Privacy Notice (Notice) for visitors of our website https://www.auglinn.com/ or Auglinn mobile application (‘’Service’’), for our users as well as other third parties listed below (also referred to as ‘’you’’) to describe who we are, how we process your personal information and for which purposes, and the rights that you have in connection with such processing.

Auglinn is a company registered in Wilmington, Delaware, US with a registered office at Wilmington, Delaware 19802-4447 US. The data controller responsible for your personal information collected through this Website is Auglinn. If you are using our Service through our mobile application, the data controller of your personal information collected in the context of such relationship will be Auglinn.

Auglinn provides the following services:

a)    Augmented Reality Location Tagging: Auglinn provides a unique service enabling users to leave virtual notes, stories, and experiences in the form of 3D boxes using augmented reality. These digital annotations, referred to as "boxes" or “items” are placed at specific physical locations, offering a dynamic layer of user-generated content in the real world.


b)    Community Building and Social Networking: Auglinn functions as a social network, fostering community engagement. Users can follow diverse communities (which we call ‘Spaces’), connect and collaborate with like-minded individuals, and share insights, stories, and recommendations related to specific locations or themes.


c)    Historical and Cultural Documentation: Auglinn serves as a platform for the documentation and preservation of historical and cultural experiences. Users contribute to the living history of their surroundings by sharing anecdotes, local folklore, and significant events associated with specific locations.


d)    Content Curation Beyond Traditional Platforms: Auglinn offers curated content that goes beyond typical categories found in services such as Google Maps or TripAdvisor. This includes unique and hard-to-find information such as film shooting locations, hidden natural wonders, and culturally significant sites.


e)    Exploration of Unconventional Points of Interest: Auglinn encourages users to explore unconventional points of interest, such as street art and interactive installations, providing a fresh and alternative perspective on their surroundings.


f)    Professional Pinpointing and Collaboration for Entities: Auglinn extends its services to entities, including municipalities, NGOs, and companies, serving as an internal pinpointing and communication tool for professional use. Professions such as urban planners, architects, municipal employees, project managers, and team members can leverage Auglinn's augmented reality features to tag specific locations, share information, and collaborate seamlessly for professional reasons including, but not limited to, internal communication, project management streamlining, and the facilitation of the efficient addressing of areas or issues within a professional context.


g)    Promotion of Ethical and Responsible Content: Auglinn emphasizes responsible content creation, encouraging users to share meaningful and positive experiences. The platform actively discourages inappropriate or harmful content, fostering a safe and respectful community.


h)    Real-time and Time-Independent Interaction: Auglinn allows users to engage with content both in real-time and time-independently, ensuring a flexible and accessible user experience.

Auglinn can be accessed through its website (www.auglinn.com) and is available for download at the iOS App Store, and the Google Play Store. The Privacy Notice and Terms of Use used for this evaluation can be found on Auglinn’s website, iOS App Store, and the Google Play Store.

Auglinn now offers Auglinn Skyview, a web-based platform that allows users to create and manage maps from their desktop. Auglinn Skyview is available under various subscription plans, including Free (Basic), Light, Pro, and Premium. These plans offer different levels of access and features tailored to meet the needs of individuals, businesses, and professional entities.

2. Definitions
 
SERVICE means the https://www.auglinn.com/ website, Auglinn mobile application, and Auglinn Skyview, a web-based platform for map creation and management, operated by Auglinn Inc.
 
PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).
 
USAGE DATA is data collected automatically either generated by the use of Service or from Service infrastructure itself (for example, the duration of a page visit).
 
COOKIES are small files stored on your device (computer or mobile device).
 
DATA CONTROLLER means a natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are, or are to be, processed. For the purpose of this Privacy Notice, we are a Data Controller of your data.
 
DATA PROCESSORS (OR SERVICE PROVIDERS) means any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Service Providers in order to process your data more effectively.
 
DATA SUBJECT is any living individual who is the subject of Personal Data.

Where this is the case, you provide us with information including your age and the in-app username that you choose to use on our Services. We collect and use this information in order to authenticate you when you register an account and use the Services, to make sure you are eligible and able to receive the Services, and so that you receive the correct version of the Services.

Usage Data
We may also collect information that your browser sends whenever you visit our Service or when you access Service by or through a mobile device (“Usage Data”).
 
This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
 
When you access Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

 

For our web-based platform, Auglinn Skyview, additional data may be collected, including but not limited to, browser extensions you may have installed, cookies specific to desktop environments, and interactions with web-based features. This data helps us optimize the user experience across different devices and platforms.
 
Location Data
We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, and to improve and customize our Service.
 
You can enable or disable location services when you use our Service at any time by way of your device settings.
 
Tracking Cookies Data
We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information.
 
Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyze our Service.

 

In addition to cookies used for our mobile application, our web platform uses cookies to manage user sessions, track user preferences, and collect analytics data to enhance the user experience on Auglinn Skyview.

Auglinn Inc. uses the collected data for various purposes:

6. Retention of Data
 
We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Notice. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

 

We will also retain subscription and payment data as long as necessary to manage your account and comply with legal obligations, such as financial reporting requirements. After this period, payment data will be securely deleted or anonymized.
 
Additionally, we will retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.
 
7. Transfer of Data
 
Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

We process your personal data that you have provided to us through our Service Provider/ sub-processor AWS - Amazon in their data centers in Frankfurt, Germany. 

Your consent to this Privacy Notice followed by your submission of such information represents your agreement to that transfer.
 
Auglinn Inc. will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Notice and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.
 
8. Disclosure of Data
 
We may disclose personal information that we collect, or you provide:
 
(a)  Disclosure for Law Enforcement.
Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.
 
(b)  Business Transaction.
If we or our subsidiaries are involved in a merger, acquisition or asset sale, your Personal Data may be transferred.
 
(c)  Other cases. We may disclose your information also:
 
(i) to our subsidiaries and affiliates;
 
(ii) to contractors, service providers, and other third parties we use to support our business, including payment processors, web hosting providers, security monitoring services, cloud storage providers, and analytics services;

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

For our web-based platform, Auglinn Skyview, we use additional security measures including HTTPS encryption, regular security audits, and protection against common web vulnerabilities to safeguard your data.

 

In the event of a data breach that affects your Personal Data, we will notify you promptly in accordance with applicable data protection laws. We will provide information on the nature of the breach, the data affected, and the steps we are taking to mitigate the impact and prevent future incidents.
 
10. Your Data Protection Rights Under General Data Protection Regulation (GDPR)

(e)  the right to data portability. You have the right to be provided with a copy of your Personal Data in a structured, machine-readable and commonly used format;

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy notice. Our Notice on “Do Not Track” Signals:

If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same.
